TERMS AND CONDITIONS
The offer and sale of products on our website (https://baba-store.it/) are governed by these General Terms and Conditions of Sale. To contact us, you can find all contact details in the Contact and Support section.
SALE
The Seller offers for sale on https://baba-store.it/ original products from the following brands: Converse, Nike, entirely personalized and customized by hand in our internal laboratory, and conducts its e-commerce activity exclusively with end-users. The Seller reserves the right not to process orders from parties other than end-users or orders that do not comply with its commercial policy.
Gift Cards
Gift Cards purchased on the Website constitute a prepaid credit exclusively usable for the purchase of products available on www.baba-store.it.
Unless otherwise indicated on the purchase page, Gift Cards:
a) are not refundable, in whole or in part;
b) are not convertible into cash nor do they entitle to a refund of the amount paid;
c) can be used within the validity period indicated at the time of purchase;
d) are not replaceable in case of loss, theft, damage, or unauthorized use;
e) can be used in a single transaction or, if technically allowed, in multiple transactions until the credit is exhausted.
The purchase and/or use of the Gift Card implies acceptance of these General Terms and Conditions of Sale.
Discount Vouchers and Promotional Codes
Discount Vouchers and Promotional Codes do not represent a prepaid credit and have no monetary value.
Such instruments are non-refundable, not convertible into cash, and do not entitle to any refund if not used by the expiry date.
Each Discount Voucher or Promotional Code is subject to the specific conditions indicated in the relevant communication or promotional page, including any usage limitations, minimum order amount, or product exclusions.
The Seller is not responsible for any loss, theft, damage, or improper use of Discount Vouchers or Promotional Codes after their issue.
Abuse and Fraudulent Use
The Seller reserves the right to cancel Gift Cards, Discount Vouchers, or Promotional Codes in case of suspected fraudulent, improper use, or use contrary to these Conditions.
Applicable Law
The regulations for Gift Cards and Discount Vouchers comply with the Consumer Code (Legislative Decree 206/2005) and the current legislation on voucher schemes.
HOW TO PURCHASE
To purchase one or more products on https://baba-store.it/, it is necessary to choose the product (model, size, color) and complete the electronic order form (personal, billing, and shipping data). The transmission to the Seller, via telematics, is automatic. The order form contains a reference to the General Terms and Conditions of Sale (this page) and a summary of information on the essential characteristics of each ordered product and its price (including all applicable taxes or duties), the payment methods you can use to purchase each product, and the delivery methods for purchased products and related shipping costs. The contract is considered concluded when the Seller receives your order form via telematics, after verifying the correctness of your order data. The order form will be archived in our database for the period necessary to process orders and in any case within legal terms. Once the contract is concluded, we will take charge of your purchase order. The Seller may not process purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect, or in case of unavailability of products. In these cases, we will inform you by email or phone call that the contract is not concluded and that the Seller has not processed your purchase order, specifying the reasons. If the products presented on https://baba-store.it/ are no longer available or for sale at the time of your last access to the site or sending of the order form, the Seller will promptly inform you, and in any case within thirty (30) days from the day following that on which you transmitted your order to the Seller, of the eventual unavailability of the ordered products. In case of submission of the order form and payment of the price, the Seller will refund any amount already paid by you. By electronically submitting the order form, you unconditionally accept and undertake to observe, in your dealings with the Seller, these General Terms and Conditions of Sale and the Privacy Policy. If you do not agree with some of the terms set out in the General Terms and Conditions of Sale, we invite you not to submit the order form for the purchase of products on https://baba-store.it/. Once the contract is concluded, the Seller will send you, via email, a receipt of the purchase order, containing a summary of the information already contained in the order form (information on the essential characteristics of the product and detailed indication of the price, payment methods, and delivery costs).
PRODUCTS AND WARRANTY
On https://baba-store.it/, only branded and original products are offered for sale, which we purchase directly from carefully selected and authorized fashion houses, manufacturers, and retailers, and which are customized with manual processing. Therefore, they are considered limited edition products. The Seller does not sell used products; the manual processing and finishes (including "dirtying" or aging/wearing of the shoe) are part of the product and are sold as such. Manual processing makes the product unique, so it may differ slightly from the product images presented on the site. The essential characteristics of the products are presented on https://baba-store.it/ within each product sheet. Images and colors of products may not correspond to actual ones due to the Internet browser and monitor used. Product prices may be subject to updates. Please check the final selling price before submitting the relevant order form. Purchase requests from countries not included among those displayed on the order page cannot be accepted by the Seller. The warranty for these products is offered directly by https://baba-store.it/.
RIGHT OF WITHDRAWAL
You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased on https://baba-store.it/. Follow the instructions you find in the Shipping, Exchanges & Returns section. You will be contacted by one of our representatives. In the event of you exercising your right of withdrawal, the Seller has the right not to accept the return of products that have been used, altered in their essential and qualitative characteristics, or that have been washed or damaged. Any shipping costs for returning products to the seller are borne by the buyer.
APPLICABLE LAW AND DISPUTE RESOLUTION
These General Terms and Conditions of Sale are governed by Italian law and, in particular, by Legislative Decree 6 September 2005 no. 206, on the consumer code, with specific reference to regulations concerning distance contracts, and by Legislative Decree 9 April 2003 no. 70 on certain aspects concerning electronic commerce. In the event of disputes between the Seller and each end-user, the competent court is that of Rome.
"If you buy with Scalapay, you receive your order immediately and pay in the number of installments you have chosen. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., to related parties and their assignees, and you authorize this transfer."
